Terms of Service

This is a working draft prepared to match Kitscore's current product (evaluations, accounts, evidence submission, mutual campaign confirmation, and paid plans via Stripe). It is not legal advice. Have a lawyer review it — particularly the liability, dispute, and refund sections — before relying on it at scale.

1. Who we are

Kitscore (the "Service," "we," "us") is operated by GHG Consulting LLC, a New York State registered limited liability company. These Terms govern your access to and use of kitscore.co and any related apps, accounts, or services (together, the "Service").

By creating an account, submitting evidence, requesting an evaluation, or making a payment, you agree to these Terms. If you don't agree, don't use the Service.

2. Eligibility

You must be 18 or older to use Kitscore, and you must have the authority to bind the company or individual you represent (as a creator or as a sponsor) to these Terms.

3. Accounts

You're responsible for the accuracy of the information you provide and for keeping your login credentials secure. You're responsible for activity that happens under your account. Tell us promptly at hello@kitscore.co if you suspect unauthorized access.

4. What Kitscore does

Kitscore is a sponsorship due-diligence platform. It generates Trust Scores, Reliability Scores, and decision memos for creators based on a combination of self-reported information, evidence submitted by creators, live-verified platform data where available, and mutually confirmed campaign records between creators and sponsors.

Kitscore scores and reports are informational, not a guarantee. They reflect the evidence available to us at the time of generation and are not a substitute for your own due diligence, contract negotiation, or judgment. We do not guarantee the accuracy of self-reported or evidence-submitted data, and we are not a party to, and bear no liability for, any sponsorship agreement, payment, or dispute between a creator and a sponsor.

Creators may optionally connect a YouTube, TikTok, Instagram, Twitch, or Discord account so Kitscore can verify account (or, for Discord, server) ownership and read public statistics used in scoring. Doing so is subject to the applicable platform's own terms, including the YouTube Terms of Service (Google's use of your data is described in the Google Privacy Policy), the Meta Terms of Service for Instagram connections, the Twitch Terms of Service for Twitch connections, and the Discord Terms of Service for Discord connections. You can disconnect a platform account at any time by revoking access from that platform's own account settings and asking us to remove the connection.

5. Creator content and evidence

When you submit evidence (screenshots, analytics exports, campaign documentation, etc.), you confirm you have the right to share it and that it's accurate to the best of your knowledge. We may review, verify, reject, or request clarification on submitted evidence. Falsifying evidence or misrepresenting campaign outcomes may result in suspension or termination of your account and removal of associated scores.

6. Mutual campaign confirmation

Verified Campaigns require independent confirmation from both the creator and the sponsor involved. Neither party can unilaterally confirm a campaign on the other's behalf. Disputes about whether a campaign occurred, or about its outcome, are between the creator and sponsor — Kitscore does not arbitrate these disputes, though we may remove a Verified Campaign badge if we receive credible evidence that it was fraudulently confirmed.

7. Payments, plans, and billing

Paid evaluations and subscriptions are processed via Stripe. By purchasing an evaluation or subscribing to a plan, you authorize us to charge the payment method on file for the listed price and, for subscriptions, on each renewal until you cancel.

8. Refunds and cancellations

Single evaluation reports ($29)
We offer a full refund on evaluation report purchases within 48 hours of payment, no questions asked. After 48 hours, reports are non-refundable as the evaluation has been generated, delivered, and the underlying data and analysis cannot be recalled. To request a refund within this window, email billing@kitscore.co with your receipt or the creator name you evaluated.

Sponsor subscriptions (Starter $99/mo · Team $299/mo)
You may cancel your subscription at any time through the billing portal in your account settings. Cancellation takes effect at the end of your current billing period — you retain full access until then. We do not issue partial refunds for unused days in a billing period. If you were charged after you had already cancelled (for example, due to a technical error), contact us within 7 days and we will refund that charge in full.

Creator Pro subscription ($19.99/mo)
Same terms as sponsor subscriptions above — cancel anytime through your account, access continues to end of period, no partial refunds for unused days.

How to request a refund
Email billing@kitscore.co with your registered email address, the date of charge, and a brief description. We respond within 1 business day. Approved refunds are processed within 5–10 business days back to your original payment method.

Chargebacks
We ask that you contact us before initiating a chargeback with your bank or card issuer. We have a straightforward refund process and prefer to resolve disputes directly. Chargebacks made without first contacting us may result in account suspension pending resolution.

9. Acceptable use

You agree not to: misrepresent your identity or affiliation; submit fraudulent evidence or fabricate campaign confirmations; attempt to manipulate scores outside the normal evidence and confirmation process; scrape, resell, or redistribute Kitscore reports without permission; or use the Service to harass, defame, or discriminate against a creator or sponsor.

10. Intellectual property

Kitscore, its scoring methodology, design, and branding are owned by GHG Consulting LLC. Decision memos, Verified Media Kits, and other reports you purchase or generate are licensed to you for your own evaluation/sponsorship purposes — not for resale or redistribution as a standalone product.

11. Disclaimers

The Service is provided "as is." We don't warrant that scores are error-free, that the Service will be uninterrupted, or that any creator or sponsor will meet your expectations. Sponsorship and business decisions you make based on Kitscore data are your own responsibility.

12. Limitation of liability

To the maximum extent permitted by law, GHG Consulting LLC's total liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost sponsorship deals.

13. Termination

We may suspend or terminate accounts that violate these Terms, including for fraudulent evidence, payment disputes made in bad faith, or abusive conduct. You may close your account at any time by contacting hello@kitscore.co.

14. Governing law

These Terms are governed by the laws of the United States and the State of New York, without regard to conflict-of-law principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in New York State, unless otherwise required by law applicable to you as a consumer in your jurisdiction.

15. Changes to these Terms

We may update these Terms as the Service evolves. We'll update the date at the top of this page and, for material changes, notify account holders directly.
